Expert Witness Case Study: International Rescue

Corporate support Case Study

A recommendation from a barrister led us into Eastern Europe where a huge construction project had hit the buffers

Service Provided: Post-Construction – Expert Witness

The Client: Cooper & Hall was recommended by a barrister to act as an Expert Advisor on behalf of our client, an international specialist materials handling contractor, working on a waste handling plant attached to a power station in mainland Europe.

Our Role: Our client required a detailed report of the delays and changes that had occurred during the design and construction of the facility, which was two years in delay.
The case involved corporate support and Cooper & Hall examined numerous foreign language drawings and contract documents, and a vast quantity of contractor site and travel records to measure and value variations to work scope and the extended site programme. C&H produced a detailed seven-figure claim priced in euros and a fully priced and particularised schedule of delays which included an assessment of the additional cost of the extended collateral and product warranties.

The Outcome: A fully explanatory, clear and comprehensive report was produced by C&H which quantified each design alteration, the reason for each delay, and all associated costs.
This led to a satisfactory negotiated settlement for our client without the need for an expensive arbitration.
